HANSON CONSERVATION COMMISSION
        MINUTES OF THE PUBLIC MEETING OF JANUARY 28, 2014       
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:00 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by John Kemmett, Chairman, in Meeting Room A at the Town Hall.

Discussions

        Mr. Clemons updated the Commission regarding the status of the Poor Meadow Conservation Area off of West Washington and Holmes Street (The State recently approved a grant in the amount of $82,800 to purchase this parcel with additional funds coming from the Community Preservation Act.)  Mr. Clemons commented that the Department of Conservation and Recreation had just mailed back the completed contract form to the Town with all the required signatures for the grant.  The accompanying cover letter outlined a process with a list of outstanding items to be accomplished such as:  clearing the title and and an environmental assessment, both of which have to be performed within a relatively short period of time.  Mr. Clemons added that the deadline is June 30, 2014, if not sooner.  
        Mr. Harris asked when a sign needed to be posted as well as the timetable for the construction of the parking lot.  Mr. Clemons answered that they are both requirements for receipt of the grant.  He said that Newcomb Tree Service had volunteered to clear the parcel for the parking area.  Mr. Clemons left the meeting at 7:05 PM due to another obligation.

Public Hearings

7:00 PM  Notice of Intent for a proposal to construct an unattached garage with minor grading within 100 feet of a Bordering Vegetated Wetland at 5 Joshua Lane, Map 37, Lot 1-1P for  
Gary Condon represented by Land Planning, Inc., 1115 Main Street, Hanson, MA  02341 (DEP#SE175-0643) (New Hearing)

        Mr. Steve Wry, Project Engineer for Land Planning, Inc. made the presentation for a proposed un-attached garage on an existing 4 acre lot.  The lot consists of an existing house, driveway and an easement to an abutting property.  The dimensions of the garage are to be 28’ x 28’ with a 6’ x 22’ addition.  A short driveway for access to the garage is also proposed.  The wetland depicted on the Plan (dated December 30, 2014) was delineated by Tunk Associates with associated 50’ and 100’ buffer zones.  The removal of some trees and about 12 feet of minor grading extend into the 100’ buffer zone which necessitated the filing of a Notice of Intent.  Erosion control is proposed at the limit of work.  Mr. Kemmett asked for comments from abutters.  Those present were:
Ms. Kathy Holt, 3 Joshua Lane – had concerns with flooding onto her driveway.  Mr. Wry answered that her driveway (the easement across Mr. Condon’s property) is actually up-gradient from the garage.  Mr. Condon, who was present, added that he will be using the garage mainly as storage for his business.

Appointments

7:15 PM  Appointment with Mr. Al Hanscom and Mr. David Blauss to discuss erosion control and the jetty at Camp Kiwanee

        Representing Camp Kiwanee, Mr. Hanscom, P.E. attended the meeting and distributed draft copies of an updated Beach Erosion Control & Maintenance Plan and pictures of the newly constructed sedimentation basin to handle runoff from the parking lot.  Mr. Kemmett asked about the outlet pipe being clogged with sand.  Mr. Hanscom said that there was very little sand in the pipe.  He added that Maquan Pond is low right now, but if the water levels went up, it would flow quite readily.  Mr. Harris commented that he was also concerned a couple of weeks ago that the pipe was clogged.  Mr. Hanscom said that he would check it and get back to the Commission.   He said that in the past, the Town’s Water Department has jetted out the pipe of significant quantities of sand.  
        Mr. Hanscom explained that he would be submitting an updated O & M Plan and maintenance and inspection forms to be used twice a year in the Spring and Fall and after significant rainfall events.  The inspections shall be performed initially by himself, the Conservation Agent and a representative from Camp Kiwanee.  Mr. Hanscom also said that a Chapter 91 License was acquired from the State to install the stone jetty, but one was never issued for the docks.  He has encouraged Dave Blauss to get that.  When Mr. Blauss arrived at 7:25 PM, Mr. Hanscom repeated that the pipe was possibly clogged and reminded him about the bi-annual inspections.      

Old Business/New Business

Request for a Certificate of Compliance for All American Assisted Living at Hanson, 1074 West Washington Street, Map 104 (Hanson), 67 (E. Bridgewater), Lot 1 (Hanson), Lot 6A (E. Bridgewater for SHI-II Hanson, LLC, 30 Jericho Executive Plaza, Suite 400E, Jericho, NY  11753 (DEP #SE175-612) – requires vote

        Ms. Muncy reported that there were three outstanding items in the Order of Conditions:  Post Construction water quality which must be monitored annually for 5 years, Monitoring of the

Mitigation plantings by a qualified wetland scientist, also for 5 years and the submittal of an Operation and Maintenance Plan for Stormwater Management.  Mr. Josh Bows, P.E. from Merrill  Associates who attended the meeting commented “Duly noted.”  He was of the opinion that an
O & M Plan had already been submitted, but that his client would have no problem with perpetual conditions in the Certificate of Compliance.  Ms. Muncy commended the Assisted Living for doing a great job with the mitigation plantings.  Mr. Bows mentioned that they had spent a lot of money for a landscape architect and they had even added a few additional plantings.

Request for a Certificate of Compliance for 314 Woodbine Ave., Map 3, Lot 7 for Jeff Gosselin, P.O. Box 1072, Plymouth, MA  02260 (DEP #SE175-0634)   

        Ms. Muncy inspected today and said that the project was in compliance except for stabilization of the site, which will be completed in the spring and she couldn’t locate the required Conservation posts.  Therefore, she recommended issuance of a Partial Certificate of Compliance and hold it back until she has an opportunity to talk to the owner about the posts.
